Westport-maglev land condemnation case set to head to jury trial

A jury trial is set to open July 10 centered on land condemnation rights sought by Baltimore Washington Rapid Rail (BWRR). The firm is seeking to build a $10 billion high-speed train or maglev that can make a one-way trip from Baltimore to Washington, D.C. in 15 minutes using magnetic levitation.

But that quest would wipe out a plan by Stonewall Capital and developer Ray Jackson to create a new urban waterfront community there.

Funding sources for the maglev include federal funds and money from the Japanese government, which are not yet committed, said Matthew Sturtz, a partner at Nelson Mullins, which is representing Stonewall, on May 8.

Both sides have continued to trade barbs over the site and its future.

A trial in Baltimore City Circuit Court to determine whether a high-speed train will be built in Westport on land obtained through condemnation has been postponed.

Judge Lawrence Fletcher-Hill on Monday rescheduled the case to Aug. 22 just as jury selection was set to begin downtown. Ray Jackson, principal of Stonewall Capital and the defendant in the lawsuit that is a bitter feud over land rights in South Baltimore, said the reason was that the judge had tested positive for Covid-19. In the meantime, the two sides said they plan to continue talks about a possible settlement.

The jury trial was to decide the future of 43 now-barren acres in Westport that is coveted by both Stonewall Capital and the Baltimore Washington Rapid Rail (BWRR) group.
