Appeal by citizens' group rejected

In a lawsuit filed against the prefecture by members of a citizens' group in Kofu City, who opposed the construction, the Supreme Court's Third Petty Bench (Chief Justice Eriko Watanabe) ruled against the citizens' appeal, saying that it was illegal for Yamanashi Prefecture to produce and distribute to schools in the prefecture a cartoon booklet highlighting the advantages of the Central Linear Railway. The decision was made on the 2nd. According to the decision, the prefectural government is now liable for the loss of the case.
According to the ruling, the prefectural government produced a booklet titled "The Changing Image of Yamanashi with Linear Motion" and distributed about 110,000 copies in 2008. The plaintiffs claimed that the booklet was biased because it did not address the negative aspects of the project, such as the impact on the natural environment.
In June 2020, the Kofu District Court of the first instance dismissed the case, saying that the booklet did not impose a particular view, and the Tokyo High Court of the second instance upheld the decision.
